Welcome to Root & Cap. These Terms of Service govern your use of the website rootandcap.com (the "Site") and any purchase you make from it. Root & Cap is a small independent apparel brand based in Detroit, Michigan, USA, operated by Adam.
By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Site or purchase our products.
We sell screen-printed heavyweight t-shirts and related apparel. All prices are listed in U.S. dollars and typically range from $62 to $72 per shirt. We make every effort to display product details, colors, and pricing accurately, but we do not warrant that descriptions or other content are completely error-free. Prices are subject to change without notice. If a pricing error is discovered after an order is placed, we reserve the right to cancel that order and issue a full refund.
All payments are processed securely by Square, our third-party payment processor. By placing an order you authorize us, through Square, to charge your selected payment method for the total order amount including any applicable taxes and shipping. Root & Cap does not collect, see, or store your full payment card details. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or product unavailability.
All graphics, prints, designs, photography, text, and the Root & Cap name and logo are the original creative work of Adam and Root & Cap, and are protected by applicable copyright and trademark law. You may not reproduce, copy, resell, or create derivative works from any of our designs without prior written permission.
Many of our pieces are produced in limited runs and printed to order. Inventory is not guaranteed, and once a run sells out it may not be restocked. We are not liable for items being unavailable or for any drop selling out.
The Site and all products are provided "as is." To the fullest extent permitted by law, Root & Cap and Adam shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.
These Terms are governed by and construed in accordance with the laws of the State of Michigan, USA, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be subject to the jurisdiction of the state and federal courts located in Michigan.
We may update these Terms from time to time. Changes take effect when posted to this page, and the "Last updated" date will be revised accordingly. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
